Manchester County Court – Costs Draftsman/Lawyer Assistance
At ARC Costs, our expert Costs Draftsman and Costs Lawyers regularly help legal professionals, and Litigants in Persons in recovering their costs, or opposing cost claims against them at Manchester County Court.
On conclusion of proceedings (whether this is via a Court Order, acceptance of an offer, Notice of Discontinuance or strike out of a claim), the issue of costs will need to be considered. The general rule under CPR 44.2 is that the losing party should pay the receiving party’s costs, and in certain circumstances, a deemed order for costs is already made (for instance acceptance of a CPR 36 offer).
Summary Assessment
If N260s have been filed in advance of any hearing at the Manchester County Court, summary assessment of costs may take place if the matter has been listed for a Fast Track Trial or, if an interim application, the matter has been dealt with in under 1 day.
Quite often however, where costs cannot be summarily assessed (due to lack of time, complexity or the hearing being outside the usual scope of summary assessment parameters), an order for detailed assessment will take place.
What is Detailed Assessment?
Detailed assessment is the process by which the parties and Court undertake a forensic analysis of the costs claimed, in order to come to a conclusion as to how much should be payable by one party to the other.
Whilst the detailed assessment of costs is a Court process, in most cases it does not result in a further Court hearing being required, and on most occasions costs are agreed between the parties via negotiations.
Based in the North but providing a nationwide service, ARC Costs are well placed to deal with all nature of costs disputes at Manchester County Court.
