Birmingham County Court – Costs Draftsman/Lawyer Assistance

At ARC Costs, our expert Costs Draftsman and Costs Lawyers regularly assist legal professionals, and Litigants in Persons in recovering their costs, or opposing cost claims against them at Birmingham County Court.

At the end of proceedings (whether this is via a Court Order, acceptance of an offer, Notice of Discontinuance or strike out of a claim), the issue of costs will need to be considered. The general rule under CPR 44.2 is that the losing party should pay the winning party’s costs. In some cases, a deemed order for costs is already made (for instance acceptance of a CPR 36 offer).

Summary Assessment

If N260s have been filed in advance of any hearing at the Birmingham County Court, summary assessment of costs may take place if the matter has been listed for a Fast Track Trial or, if an interim application, the matter has been dealt with in under 1 day.

In cases where costs cannot be summarily assessed (due to lack of time, complexity or the hearing being outside the usual scope of summary assessment parameters), an order for detailed assessment will take place.

What is Detailed Assessment?

Detailed assessment is the process by which the parties and Court undertake a forensic analysis of the costs claimed, in order to come to a conclusion as to how much should be payable by one party to the other.

Whilst the detailed assessment of costs is a Court process, in most cases, it does not result in a further Court hearing being required. On most occasions, costs are agreed between the parties via negotiations.

Based in the North but providing a nationwide service, ARC Costs are well placed to deal with all nature of costs disputes at Birmingham County Court.

How Can ARC Costs Assist?

As independent costs experts, we can represent paying or receiving parties.

If you are receiving party, we are able to assist with the preparation and negotiation of Costs Budgets, as well as the settling and negotiation of any electronic Bill of Costs on conclusion of the case, including the preparation of any legal arguments in the form of Points of Reply if necessary.

If you are a paying party, we prepare Points of Dispute to set out the legal means by which the other side’s costs can be reduced, and conduct negotiations to reduce the level of the legal costs burden you will face.

Irrespective of which side of the fence you are on, ARC Costs can assist, and our Costs Lawyers are authorised to conduct costs proceedings (and we can go on Court record to do so), and have rights of audience to conduct advocacy on your behalf (at any CCMC or detailed assessment hearing).

To get in touch with the team, email us at, or call one of our experts on 01204 397302 and please ask for details on how we can assist. Case studies of our work are available here, and we provide a nationwide service and regularly attend at Birmingham County Court, Manchester County Court and Central London County Court, as well as other popular Court locations.
