Summary Assessment

If N260s have been filed in advance of any hearing at the Birmingham County Court, summary assessment of costs may take place if the matter has been listed for a Fast Track Trial or, if an interim application, the matter has been dealt with in under 1 day.

In cases where costs cannot be summarily assessed (due to lack of time, complexity or the hearing being outside the usual scope of summary assessment parameters), an order for detailed assessment will take place.

What is Detailed Assessment?

Detailed assessment is the process by which the parties and Court undertake a forensic analysis of the costs claimed, in order to come to a conclusion as to how much should be payable by one party to the other.

Whilst the detailed assessment of costs is a Court process, in most cases, it does not result in a further Court hearing being required. On most occasions, costs are agreed between the parties via negotiations.
