What Does A Costs Lawyer Do?
A Costs Lawyer is a qualified and fully regulated legal professional, specialising in the area of costs law. They hold rights of audience, and can conduct costs litigation on your behalf. They can go on Court record to act for you, akin to a Solicitor.
Qualified Costs Lawyers are regulated by the Costs Lawyers Standards Board (CLSB). Most Costs Lawyers are also members of the Association of Costs Lawyers (ACL), which promotes the interests of costs lawyers.
These professionals are required to complete a substantial modular training course and follow the Costs Lawyer Code of Conduct. They are required to keep up to date in the area of costs law through continued professional development. This ensures they remain competent in all aspects of legal costs. All Costs Lawyers in England and Wales are also required to carry Professional Indemnity Insurance.
Costs Lawyers are regulated, like a Solicitor or member of CILEX. Under the Legal Services Act 2007, their practising certificate enables them to exercise rights of audience in Court, and they are also able to conduct litigation and administer oaths in relation to costs proceedings. As such if required, a Costs Lawyer is able to be on Court record to conduct costs proceedings on behalf of a Solicitor or Litigant in Person.
