The Shamima Begum case has become one of the most controversial legal and political issues in the UK in recent years. The decision to grant her legal aid was a controversial decision and has sparked widespread debate.

 

Shamima Begum Recent Case Update

In a recent update, Shamima Begum faced a significant legal setback when the UK Supreme Court refused to hear her appeal against the decision to strip her of British citizenship. Ms Begum, who left the UK as a teenager in February 2015 to join the Islamic State in Syria, has been embroiled in legal battles ever since her citizenship was revoked in 2019 by the then-Home Secretary, Sajid Javid, on national security grounds.

Begum’s legal team argued that she was trafficked as a child and that the decision to revoke her citizenship was unlawful. However, the Supreme Court has ruled that her case did not raise an “arguable point of law,” effectively ending her legal avenues to challenge the citizenship removal.

This decision follows an earlier ruling by the Court of Appeal, which emphasised that the threat to national security outweighed other considerations, including the argument that Begum was a victim of trafficking.

 

Shamima Begum Legal Aid Costs Matters

 

One of the most contentious aspects of the Shamima Begum case has been her access to legal aid—a government-funded program that helps individuals cover the costs of legal representation in cases where they cannot afford it.

In Begum’s situation, her ability to secure legal representation was complicated by the revocation of her citizenship by the Home Office. Her legal team argued that she should be allowed to return to the UK to challenge the decision, asserting that stripping her of citizenship without providing her the means to contest it was a violation of her rights.

The legal aid provided in such high-profile cases often includes significant resources and expertise due to the complexities of international law, human rights, and national security. Shamima Begum Legal Aid Costs – How Much Has Been Spent?

Deprivation of Citizenship cases are heard in the Special Immigration Appeals Commission (SIAC). Under the Legal Aid Act 2012, all cases under the Special Immigration Appeals Commission have scope for legal aid, and Shamima Begum’s case was granted legal aid funding by the Legal Aid Agency.

Although it is difficult to accurately estimate the level of legal costs associated with Begum’s unsuccessful battle to return to Britain, her lawyers have been involved in multiple legal challenges since 2019, including Court of Appeal cases and a five-day hearing in November 2022. Therefore, it is likely that the legal costs associated with such proceedings would be significant.

The legal costs associated with this type of case will typically involve barrister’s hourly rates, solicitor’s hourly rates, court fees, and expert witness fees. It has been reported that costs could now be around £250,000 in legal aid – although this is likely to be more following the recent Supreme Court case; however, the true costs of the case will not be made available to the public.
