Background to the Guideline Hourly Rates

The guideline system is designed to promote fairness, consistency, and proportionality while allowing flexibility for the courts to reflect the circumstances of individual cases. The GHR apply nationally, but are divided into bands that recognise regional variations in legal markets and operating costs.

The reforms introduced after October 2021 were intended to address concerns that the rates had fallen behind inflation and no longer reflected the realities of practice. As a result, further rate increases were approved following data gathered from firms across England and Wales, including areas such as Berkshire, Buckinghamshire, Dorset, Essex, Hampshire, and Wight Kent Middlesex Oxfordshire.

Middlesex and the National Band Structure

Middlesex occupies a distinctive position within the guideline framework. Although historically associated with London, Middlesex is not automatically included in London 1–3 for guideline purposes. Instead, the applicable band depends on the precise location of the firm and the nature of the work undertaken.

Although Middlesex is a historic county, many areas traditionally associated with Middlesex now fall within London borough boundaries and are therefore classified within the ‘London Boroughs plus Dartford’ guideline band.

Firms located outside London boroughs, even if historically linked to Middlesex, are generally treated as National Band 1. This distinction is important when preparing costs budgets and Bills of Costs, as the applicable guideline rate may differ significantly

The London bands apply primarily to firms operating in central London, particularly those located within postcodes W1, WC1, WC2 and SW1. These areas attract higher guideline rates, reflecting the overheads and market conditions faced by centrally based London firms.

Current Guideline Hourly Rates in Middlesex

Where Middlesex firms fall within National Band 1, the current guideline hourly rates (effective from 1 January 2026 and still current) are:

Grade A: Solicitors and legal executives with over 8 years’ experience – £295

Grade B: Solicitors and legal executives with over 4 years’ experience – £247

Grade C: Other solicitors, legal executives, or equivalent fee earners – £201

Grade D: Trainee solicitors, paralegals, and junior fee earners – £142

These figures form the starting point for summary assessment, detailed assessment, and costs management hearings.

Applying the Rates in Practice

The guideline rates are influential but not mandatory caps. Courts retain discretion to depart from them where the circumstances justify it. When applying the rates, practitioners should consider:

  • the complexity and value of the dispute
  • the expertise and seniority of the fee earners involved
  • whether the work mirrors that undertaken by centrally based London firms
  • overall proportionality

Any departure should be clearly explained within a Precedent H costs budget or Bill of Costs to assist the court at assessment.

Regional Context and Consistency

The GHR framework seeks to maintain consistency across regions, whether dealing with matters in Isle of Wight Kent, Middlesex, or other National Band 1 areas. This consistency is overseen by the Civil Justice Council, ensuring that regional differences are recognised without undermining fairness or access to justice.
