The guideline hourly rates Kent practitioners rely on continue to play a central role in the assessment and recovery of legal costs across England and Wales. These rates provide a benchmark for determining what is reasonable and proportionate, forming the starting point for costs budgeting, summary assessment, and detailed assessment proceedings. For solicitors, costs lawyers, and other fee earners practising in Kent, understanding how the guideline framework applies locally is essential to effective costs management.

Background to the Current Guideline Framework

The modern structure of the guideline hourly rates is rooted in reforms that followed a significant review completed in October 2021. That review identified the need for clearer regional banding and a more evidence-based approach to hourly rates, taking account of inflation, overheads, and evolving working practices within the legal profession.

Further refinements were introduced following detailed analysis carried out by the Civil Justice Council, supported by specialist working groups that gathered data from firms across England and Wales. These recommendations were endorsed by the Master of the Rolls, ensuring judicial oversight and consistency across the civil justice system.

Kent’s Position Within the Guideline System

Kent is generally classified within National Band 1, reflecting its proximity to the capital, the strength of its legal market, and the complexity of work undertaken by many firms in the region. Kent-based practices frequently act on substantial litigation, commercial disputes, and high-value claims.

Although geographically close to central London, Kent does not fall within the London bands that apply to firms operating in the most expensive legal districts. As a result, National Band 1 rates are typically the appropriate starting point when preparing costs budgets and Bills of Costs for Kent matters.

Current Guideline Hourly Rates in Kent (National Band 1)

The following rates took effect on 1 January 2026 and remain current:

Grade Fee earner National Band 1
A Solicitors and legal executives with over 8 years’ experience £295
B Solicitors and legal executives with over 4 years’ experience £247
C Other solicitors or legal executives and fee earners of equivalent experience £201
D Trainee solicitors, paralegals and other fee earners £142

These figures represent the starting point for costs recovery on summary assessment, detailed assessment, and costs management hearings.

Applying the Rates in Practice

The guideline rates are influential but not prescriptive. Courts retain discretion to adjust rates based on the specific circumstances of the case. When applying the rates, Kent practitioners should consider:

  • the complexity and value of the dispute
  • the expertise and seniority of the fee earners involved
  • the responsibility and risk assumed
  • overall proportionality

Any departure from the guideline rates should be clearly explained within a Precedent H costs budget or Bill of Costs to assist the court at assessment.
