What is a Schedule of Costs?

A schedule of costs for a summary assessment is a document that provides a detailed breakdown of the costs incurred in a legal case. It is prepared for the purpose of assessing and determining the amount of costs to be awarded to the successful party.

The schedule of costs should follow N260 statement of costs format, but typically includes the following information:

  • Party details: The names and contact information of the parties involved in the case, including their legal representatives.
  • Description of work: A comprehensive description of the work done by the legal representatives. This may include drafting and reviewing documents, conducting research, attending hearings, and any other activities directly related to the case.
  • Time spent: The amount of time spent on each task or activity, usually recorded in units (such as hours) and multiplied by the hourly rate of the legal representative.
  • Disbursements: Any expenses incurred during the course of the case, such as court fees, expert witness fees, travel expenses, photocopying charges, and other miscellaneous costs. These expenses are usually supported by receipts or invoices.
  • Hourly rates: The applicable hourly rates for each member of the legal team involved in the case, including solicitors, barristers, and support staff. These rates may vary depending on the seniority and expertise of the individuals.
  • Total costs: The schedule will provide a subtotal for each category (e.g., professional fees, disbursements) and calculate the total amount of costs incurred by the successful party.

 

When should a schedule of costs be filed?

Practice Direction 44, Paragraph 9.5(4)(b) of the Civil Procedure Rules (CPR) governs the filing and serving of a schedule of costs where a summary assessment of costs is sought for a non-fast track trial.

Under this rule, a Schedule of Costs “must be filed and served as soon as possible and, in any event, not less 24 hours before the time fixed for the hearing.”
